Article 1 – Definitions
In these Terms and Conditions, the following terms shall have the following meanings unless the context indicates otherwise.
- Agreement: Any purchase agreement concluded through the Roberta Amsterdam website between Roberta Amsterdam and the Customer regarding the Products offered for sale.
- Customer: A natural person or company purchasing Products.
- Customer Service: Our customer service team, available at info@robertaamsterdam.com to assist with inquiries.
- Roberta Amsterdam: Roberta Amsterdam is a luxury jewelry brand based in Amsterdam, The Netherlands, registered with the Dutch Chamber of Commerce under registration number 94570299.
- Intellectual Property Rights: All copyright, trademark rights, design and model rights, and other rights pertaining to intellectual property.
- Order: Any request by a Customer to purchase one or more Products.
- Personal Data: Information provided by the Customer, such as name, address, and payment details.
- Products: Jewelry items as displayed on the Website and offered for sale by Roberta Amsterdam.
- Reflection Period: A period of 15 days during which the Customer may exercise the Right of Withdrawal.
- Right of Withdrawal: The right of the Customer to cancel the Agreement within the Reflection Period.
- Website: The Roberta Amsterdam website operated under the domain www.robertaamsterdam.com
Article 2 – General
2.1 These Terms & Conditions apply to all legal relations between Roberta Amsterdam and the Customer, including all Agreements concerning Products purchased through the Website.
2.2 Modifications to any provision of these Terms & Conditions are valid only if explicitly agreed upon in writing.
2.3 By using the Website and placing an Order, the Customer acknowledges having read, understood, and agreed to these Terms & Conditions, as well as other applicable policies, including privacy and cookie policies.
2.4 These Terms & Conditions also benefit Roberta Amsterdam’s employees and associates.
Article 3 – Website Purchases and Reflection Period
3.1 When purchasing Products via the Website, the Customer has a 15-day Reflection Period to cancel the Agreement without providing a reason.
3.2 The Reflection Period begins the day after the Customer, or a designated third party, receives the Product(s).
3.3 Customized items, such as personalized jewelry or earrings for hygiene reasons, are excluded from the Right of Withdrawal.
3.4 During the Reflection Period, Customers should handle Products with care and only inspect them to the extent necessary to evaluate suitability, as they would in a physical store.
3.5 The Customer is liable for any decrease in the Product's value resulting from excessive handling, and Roberta Amsterdam may refund only the remaining value.
Article 4 – Right of Withdrawal
4.1 Customers may exercise their Right of Withdrawal within the 15-day Reflection Period by returning the Product in its original, unworn condition with all tags attached.
4.2 Items sold as sets must be returned together; partial returns may void any discount received.
4.3 Customers are responsible for return shipping costs and assume risk until the Product is received by Roberta Amsterdam.
4.4 Refunds will be processed within 14 days upon receipt of the returned Product and issued via the original payment method, excluding shipping fees.
4.5 Items purchased during promotional periods or with discount codes may be eligible for return; however, refunds will reflect the original purchase price. Roberta Amsterdam reserves the right to designate certain promotions as “final sale,” in which case returns will not be accepted.
4.6 Customers are responsible for return shipping costs and must use a traceable shipping method. Items should be securely packaged to prevent damage during transit. Roberta Amsterdam reserves the right to reject returns that do not meet these conditions or that are received in unsellable condition. Shape Article 5 – Prices and Payment
5.1 Product prices are displayed on the Website in euros (€), inclusive of VAT but exclusive of shipping fees, which are calculated at checkout.
5.2 Prices may change, but adjustments will not affect confirmed Orders. 5.3 Payments can be made via credit cards, PayPal, and other secure options provided on the Website.
5.4 Roberta Amsterdam reserves the right to charge additional fees for delayed payments and may initiate collections for overdue amounts as outlined by Dutch law.
Article 6 – Delivery
6.1 Orders are shipped within Europe to the address specified by the Customer.
6.2 Delivery times are estimates; delays due to unforeseen circumstances are not the responsibility of Roberta Amsterdam.
6.3 In case of unavailability, Customers will be notified and offered an alternative Product or the option to cancel the Order.
6.4 Roberta Amsterdam is not liable for damage due to improper handling of Products after delivery.
6.5 The Customer is responsible for providing accurate and complete shipping information. Roberta Amsterdam is not liable for delays or additional costs arising from inaccurate address details provided by the Customer.
Article 7 – Warranty
7.1 Roberta Amsterdam guarantees that Products are free from material defects for six months post-delivery.
7.2 This warranty does not apply to normal wear and tear or to damage resulting from improper handling or unauthorized repairs.
Article 8 – Complaints
8.1 Complaints must be submitted to Customer Service within 15 days of Product delivery, including a detailed description of the issue.
8.2 Roberta Amsterdam will respond to complaints within 15 days, providing an update on the next steps or expected resolution.
8.3 If a complaint cannot be resolved, the Customer may pursue legal remedies through the competent Dutch court.
Article 9 – Intellectual Property and Personal Data
9.1 All intellectual property rights related to Products and the Website belong to Roberta Amsterdam.
9.2 All content on the Website, including images, text, logos, and designs, is protected under intellectual property laws. Unauthorized use or reproduction of any Website content is strictly prohibited without express written consent from Roberta Amsterdam.
Article 10 – Force Majeure
10.1 Roberta Amsterdam is not liable for delays or failures due to circumstances beyond its reasonable control, including supply chain disruptions or acts of nature.
10.2 In such cases, Roberta Amsterdam reserves the right to suspend or cancel the Agreement without liability for damages, as governed by Dutch law.
Article 11 – Limitation of Liability
11.1 Roberta Amsterdam’s liability is limited to the value of the Product purchased, except in cases of proven gross negligence.
11.2 The brand is not liable for damages arising from misuse of Products.
11.3 Roberta Amsterdam is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Products, except where prohibited by law. This includes, without limitation, any damages for loss of profits, data, or goodwill.
Article 12 – Governing Law and Jurisdiction
12.1 These Terms & Conditions are governed by Dutch law.
12.2 Any disputes arising from these Terms & Conditions will be resolved exclusively in the courts of Amsterdam, The Netherlands.
12.3 For all Orders shipped within Europe, the legal relationship between Roberta Amsterdam and the Customer shall be governed by Dutch law, irrespective of the Customer’s country of residence.
Article 13 – Amendments to Terms & Conditions
Roberta Amsterdam reserves the right to update these Terms & Conditions at any time without prior notice. Customers are encouraged to review these terms periodically for any changes. Orders placed after changes are published on the Website imply acceptance of the updated Terms & Conditions.
