Article 1 – About Roberta Amsterdam

These Terms and Conditions apply to purchases made through www.robertaamsterdam.com.

Roberta Amsterdam is a trade name registered in the Netherlands.

In these Terms, “Roberta Amsterdam”, “we”, “us” and “our” refer to Roberta Amsterdam. “Customer”, “you” and “your” refer to the person placing an order through our website.

Article 2 – Application of these Terms

These Terms apply to every offer, order and purchase made through our website.

Before completing an order, customers are given the opportunity to review these Terms. By placing an order, you confirm that you have read and accepted them.

Nothing in these Terms limits or excludes any mandatory consumer rights available under applicable law.

The version of the Terms in effect on the date an order is placed applies to that order. These Terms can be saved or printed for future reference.

Article 3 – Products and Product Information

We take reasonable care to present our jewelry, materials, finishes, dimensions and colours as accurately as possible.

Because jewelry is photographed under different lighting conditions and displayed on different screens, colours and proportions may appear slightly different in person. Small variations may also occur between individual pieces.

The materials, stones, plating and other characteristics stated on the relevant product page form part of the product description. Customers should review this information before ordering.

We reserve the right to correct obvious typographical, pricing or product-description errors. If an error affects an order that has already been placed, we will contact the customer and offer the choice of confirming the corrected order or cancelling it for a full refund.

Article 4 – Orders and Contract Formation

Products displayed on our website are an invitation to place an order and are subject to availability.

After placing an order, you will receive an electronic order confirmation. A purchase agreement is concluded when we accept the order and send the order confirmation, subject to successful payment and any necessary fraud or availability checks.

We may refuse or cancel an order when:

  • The product is unavailable;

  • Payment has not been authorised;

  • The delivery address is incomplete or outside our available shipping destinations;

  • We reasonably suspect fraud, misuse or unauthorised activity; or

  • There is an obvious pricing or product-information error.

If payment has already been collected for an order we cannot accept, the amount paid will be refunded using the original payment method.

Article 5 – Prices, Taxes and Payment

Prices are displayed in the currency applicable to the customer’s selected market.

For orders within the European Union, displayed prices include applicable VAT unless expressly stated otherwise.

For orders shipped to the United States, applicable import duties and taxes are included in the final price shown at checkout. If a carrier unexpectedly requests an additional import payment, please contact us before making that payment.

Shipping charges, if applicable, are displayed before the order is completed. Current shipping rates and free-shipping thresholds are provided in our Shipping Policy and at checkout.

We accept the payment methods displayed at checkout. Payment must be completed before an order is dispatched.

Promotional codes must be entered before payment and cannot normally be applied retrospectively. Unless expressly stated otherwise, promotions cannot be combined.

Article 6 – Shipping and Delivery

We ship from the Netherlands to the destinations available at checkout, including selected European countries and the United States.

We aim to dispatch in-stock orders the next day unless another dispatch period is stated on the product page or at checkout. Dispatch and delivery estimates are provided in good faith but are not guaranteed delivery dates.

Pre-orders, personalised products and made-to-order products may have different processing times. These will be communicated on the product page or during the ordering process.

If we cannot ship an order within the stated or agreed timeframe, we will notify the customer as soon as reasonably possible. The customer may accept the revised timeframe or cancel the affected order for a full refund.

Customers are responsible for providing a complete and accurate delivery address. Please contact us immediately if an address needs to be corrected. Once an order has been dispatched, we may not be able to change its destination.

We are not responsible for delays resulting from an incorrect address, an unavailable recipient, customs procedures or circumstances outside our reasonable control. This does not affect any mandatory rights relating to late or failed delivery.

For consumer purchases, responsibility for the products passes to the customer when the customer, or a person designated by the customer other than the carrier, physically receives the order.

Article 7 – EU and EEA Statutory Right of Withdrawal

Consumers residing in the European Union or European Economic Area have the statutory right to withdraw from an online purchase without providing a reason.

The statutory withdrawal period is 14 calendar days, beginning on the day after the customer, or a person designated by the customer, receives the order. If one order is delivered in separate shipments, the period begins on the day after the final product is received.

To exercise this right, the customer must inform us before the 14-day period expires by:

  • Using the clearly identified cancellation or withdrawal function on our website;

  • Emailing info@robertaamsterdam.com with an unequivocal statement that they wish to withdraw; or

  • Using the model withdrawal form included at the end of these Terms.

After notifying us, the customer must return the products without undue delay and no later than 14 days after communicating the withdrawal.

During the statutory withdrawal period, customers may inspect a product as they would reasonably be able to do in a physical shop. The customer may be responsible for any reduction in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and functioning.

This statutory right is separate from the additional 30-day return policy described below.

Article 8 – Additional 30-Day Return Policy

In addition to applicable statutory rights, Roberta Amsterdam offers customers in the European Union, European Economic Area and United States an extended return period of 30 calendar days after delivery.

To use this extended policy, the customer must request the return no later than 30 days after receiving the order.

For returns made outside the statutory EU or EEA withdrawal period, products must be:

  • Unworn and unused;

  • In their original condition;

  • Free from damage, scratches, perfume, cosmetics or other signs of use;

  • Returned with any original tags, hygiene seals and accessories; and

  • Returned in their original jewelry packaging.

Proof of purchase is required.

Sale items may be returned under the same conditions unless they were clearly identified as “Final Sale” before purchase. For EU and EEA consumers, a Final Sale designation does not remove statutory withdrawal or conformity rights where those rights apply.

The extended 30-day policy is a voluntary benefit and does not restrict any statutory consumer rights.

Article 9 – Products Excluded From Return

The right of withdrawal or voluntary return may not apply to:

  • Products made to the customer’s individual specifications;

  • Personalised or engraved jewelry;

  • Sealed earrings or other sealed piercing jewelry after the hygiene seal has been broken; and

  • Any other products that are legally excluded from withdrawal.

An earring is only treated as excluded for hygiene reasons when it was supplied with a genuine hygiene seal or sealed hygiene packaging and that seal or packaging has been broken after delivery.

These exclusions do not apply when a product is defective, damaged, incorrectly supplied or otherwise covered by mandatory consumer protection.

Article 10 – Return Procedure and Return Shipping

Before returning an order, please contact info@robertaamsterdam.com or use the return or withdrawal function available through our website.

We will provide the relevant return instructions and return address. Products should not be sent to our registered business address unless we specifically instruct you to do so.

Return shipping is not complimentary. The customer is responsible for the direct cost of returning the products unless:

  • The product is defective, damaged or incorrect;

  • We have agreed to cover the return cost; or

  • Applicable law requires us to cover it.

When we provide a prepaid return label, the cost of that label will be deducted from the refund unless the return results from our error or a product defect.

We recommend using a tracked return service and retaining proof of postage. The customer is responsible for the return shipment until it is delivered to us, except where mandatory law provides otherwise.

For international returns, customers must follow the provided customs instructions and identify the shipment as returned goods where appropriate.

Article 11 – Refunds

For an EU or EEA customer exercising the statutory right of withdrawal, we will refund all payments received for the returned order, including the cost of our least expensive standard delivery method, when the complete order is returned.

If the customer selected a more expensive delivery method, such as express delivery, we are not required to refund the additional amount above the standard delivery cost.

Original delivery costs are not refunded when only part of an order is returned, unless applicable law requires otherwise.

Statutory withdrawal refunds will be processed no later than 14 days after we receive the withdrawal notice. We may withhold the refund until we have received the returned products or the customer has provided evidence that the products were sent back, whichever occurs first.

For returns made under our voluntary 30-day policy after the statutory withdrawal period, we will refund the purchase price of eligible returned products. Original shipping charges are not refundable unless the product was defective, damaged or incorrect, or applicable law requires a refund.

Refunds are issued to the original payment method. Bank and payment-provider processing times may vary and are outside our control.

Any authorised return-label cost or permitted deduction for diminished value may be deducted from the refund.

Article 12 – Damaged, Defective or Incorrect Products

Please inspect your order after delivery and contact us as soon as reasonably possible if a product is damaged, defective or different from what was ordered.

Email info@robertaamsterdam.com with:

  • Your order number;

  • A description of the issue; and

  • Clear photographs or video showing the product and, where relevant, the packaging.

We will assess the issue and provide an appropriate solution, which may include repair, replacement, a price reduction or refund, in accordance with applicable law.

Reporting an issue after a particular number of days does not automatically remove statutory rights.

Damage caused solely by an accident, misuse, failure to follow reasonable care instructions, unauthorised repair or normal wear is not considered a manufacturing defect. This provision does not limit rights relating to a product that did not meet the description, durability claims or reasonable expectations established at the time of purchase.

Article 13 – Statutory Guarantee and Product Conformity

Nothing in these Terms limits the customer’s statutory guarantee or conformity rights.

Products must possess the quality, durability and characteristics that customers may reasonably expect, taking into account the product description, materials, price, intended use and other relevant circumstances.

EU consumers are entitled to the applicable statutory legal guarantee. Under Dutch law, there is no single fixed conformity period: the protection may depend on the product’s nature and reasonably expected lifespan. Any commercial warranty offered by Roberta Amsterdam is additional to, and does not replace, these statutory rights.

Where a product does not conform to the purchase agreement, the customer may be entitled to repair or replacement free of charge. If an appropriate solution is not provided within a reasonable period, the customer may be entitled to a price reduction or refund in accordance with applicable law.

Article 14 – Jewelry Care and Natural Wear

Jewelry should be handled and stored with reasonable care. Care instructions are available on our Materials & Care page and may also be included with the order.

Gold plating and other surface finishes may gradually change with regular wear, friction and exposure to perfume, cosmetics, cleaning products, chlorine or other chemicals. The rate of wear varies according to use and care.

Normal wear does not automatically indicate a manufacturing defect. However, this clause does not exclude a claim where the product’s quality or durability falls below what the customer could reasonably expect based on the product description and representations made at the time of purchase.

Article 15 – Promotions and Gifts

Promotions are valid only during the stated promotional period and while stock lasts.

If a free gift was provided because an order met a minimum purchase requirement and products are later returned so that the remaining order no longer meets that requirement, the free gift must also be returned unused. If it is not returned, its stated retail value may be deducted from the refund where permitted by law.

Promotional conditions do not affect statutory consumer rights.

Article 16 – Intellectual Property

All website content, including the Roberta Amsterdam name, trademarks, designs, photographs, videos, text, graphics and other materials, belongs to Roberta Amsterdam or its licensors and is protected by applicable intellectual-property laws.

Content may not be copied, reproduced, commercially used, distributed or modified without prior written permission, except where permitted by law.

Article 17 – Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing limits mandatory consumer rights or liability for fraud, wilful misconduct, gross negligence, death or personal injury where such limitation is prohibited.

To the extent permitted by law, we are not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the purchase agreement was concluded.

We are not responsible for a failure or delay caused by events outside our reasonable control. If such an event materially affects an order, we will contact the customer and take reasonable steps to minimise the delay. Any mandatory cancellation or refund rights remain unaffected.

Article 18 – Complaints

Complaints may be submitted by email to info@robertaamsterdam.com.

Please include your name, order number and a clear description of the complaint. We aim to acknowledge complaints promptly and provide a substantive response within 14 days. If more time is required, we will inform the customer.

Customers are encouraged to contact us as soon as reasonably possible, but this does not create a strict deadline or limit statutory consumer rights.

Article 19 – Privacy

Personal information is processed in accordance with our Privacy Policy and applicable data-protection legislation, including the General Data Protection Regulation where applicable.

Article 20 – Governing Law and Jurisdiction

These Terms and purchase agreements with Roberta Amsterdam are governed by Dutch law.

For consumers, this choice of law does not deprive them of mandatory consumer protections available under the laws of their country of habitual residence.

Disputes may be brought before the courts that have jurisdiction under applicable law. Nothing in these Terms requires a consumer to bring a claim exclusively before the courts of Amsterdam where mandatory consumer-jurisdiction rules provide otherwise.

Article 21 – Changes and Severability

We may update these Terms from time to time to reflect legal, operational or business changes. Updates apply to orders placed after the revised Terms are published and do not retrospectively alter previously concluded purchase agreements.

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be interpreted or replaced as closely as legally possible to reflect its intended purpose.
